A Butte man has been resentenced for attempted sexual assault involving a nine-year-old child.
James Barnes, 45, was given a new sentence in Boulder District Court on Wednesday, according to Jefferson County Attorney Matt Johnson
Barnes was sentenced to the Montana Department of Corrections for 10 years with five years suspended with conditions.
Barnes had pleaded guilty to sexual assault of a child who was nine years old at the time of the incident, which reportedly occurred on a camping trip in June of 2006 in the Lowland campground in Jefferson County, north of Elk Park.
He was originally sentenced to seven years with four years suspended to the Montana Department of Corrections.
Johnson said a judge's ruling that the prosecution did not follow the pre-sentence agreement led to the new sentence.
