Trial has been delayed for two yellowstone county sheriffs deputies and a transport officer who have a pending discrimination lawsuit against the county.
Officers Chris Romero, Roger Bodine, and Dave Valdez have filed state and federal complaints against the county and several officials, alleging they were discriminated against because they are Hispanic.
The federal trial was expected to begin in just over two weeks, but new developments will push that date back.
One new issue is a motion filed by the deputies asking that they be allowed to sue the estate of the late sheriff Chuck Maxwell or a representative of Maxwell.
They argue the individual defendants are liable for punitive damages and that claims against Maxwell carry over past his death.
The county has countered saying Sheriff Maxwell only acted in his official capacity as sheriff and upon his death, his successor would be the named party.
Attorneys for all parties will meet with U.S. District Judge Richard Cebull next on September 16th.
