MT Supreme Court says 'no' to fake trees at Deer Lodge casino

It is not a happy ending for a Deer Lodge business. 

The Montana Supreme Court has affirmed a lower court ruling that prevents artificial palm trees at the Happy Endings Casino in Deer Lodge.

In the ruling, the justices agreed that the Powell County planning board's partial denial of a conditional use permit to install 50 trees is reasonable. However, the owners went ahead and installed 25 trees. 

The judgment states, "Private property rights were not infringed when the planning board denied portions of the permit...Happy Endings has no vested right to erect artificial palm trees on its property without approval from the county...by enforcing it's zoning regulations the county substantially complied with its growth policy."
