The Montana Attorney General's office will act as special prosecutor in a Butte investigation involving county employees.
During a special meeting on Tuesday night, the Butte-Silver Bow council approved the appointment on a 9-1 vote, with only Mike Sheehy opposed. But council members were voting for something they knew very little about.
County Attorney Eileen Joyce explained that the details of the investigation are unknown to her or anyone else in the county because of a quirk in the law.
"There hasn't been a determination by a judge that there is probable cause to file any charges, and the Attorney General's office isn't able to ask the court to make a finding of probable cause until they're appointed by this body to act within Butte-Silver Bow County. So, that's why the resolution has to come first and then they will go to court."
Joyce tells us that she was left out of the loop in the investigation because she has a conflict of interest. She also says the conflict exists because other county employees are involved.
She said that charges are expected to be filed in Butte courts on Thursday morning, and that citations or arrest warrants could be issued.
