Wyoming man one step closer to execution

A Wyoming man who is on death row for killing a Billings woman is now one step closer to being executed.

A death warrant hearing is scheduled for December 14th for Dale Wayne Eaton, who was sentenced to die for the 1988 rape and murder of Lisa Marie Kimmell, 18, of Billings.

The U.S. Supreme court has declined to review his case.

Kimmell disappeared while driving from Colorado to Billings and her body was later found in the North Platte River.

Eaton was charged with Kimmell's murder in 2003 after DNA evidence linked him to the crime.
