Law enforcement officers were justified in fatally shooting an East Helena man earlier this year, a Boulder jury has decided.
The jury returned a non-criminal verdict in a 6-1 decision Monday evening in Jefferson County. Butte-Silver Bow Coroner Lee LeBreche says the decision means that there's no evidence to charge officers with the crime and that the officers were justified in using necessary force.
Two officers responded to a call on May 29 that Douglas Morrison, 46, was intoxicated and suicidal. Officers found him on Boomerang Gulch off of Depot Hill Road near Boulder.
Police say Morrison began walking around and shooting off rounds with a Colt .45 revolver in the direction of the Montana Highway Patrol vehicles. That's when police returned fire and fatally shot Morrison.
Deputy Tom Grimsrud and MHP Trooper Dave Gleich were involved in the incident and were placed on paid administrative leave pending an investigation.
Butte-Silver Bow Coroner Lee LaBreche was selected to oversee the inquest required by state law.
