MISSOULA - The Missoula City Attorney's Office dismissed charges against two of the three daycare workers accused of leaving a child in a hot van last summer, and charges will soon be filed in the county court.
Tot Town Day Care Director Melanie Hoke and staff members Jennifer Nogle and Michelle Asby are accused of forgetting a 4-year-old boy in a van for more than two hours in July while the rest of the group watched a movie at the Carmike Cinema.
The City Attorney's Office said Nogle (pictured) received a 9-month deferred sentence, but she must testify against Hoke and Asby.
The Missoula County Attorney's Office was asked to take the case after Asby's lawyer filed a motion to dismiss, citing jurisdictional issues.
Once the county attorney agreed to take the case, the city dismissed charges.
The women were charged with two misdemeanors for leaving the child in the car and for not reporting the incident.
