HELENA - George Williams Franks of Helena, charged with attempted kidnapping, made his initial appearance by video from the Gallatin County Jail on Thursday.
Franks, 60 years old, is accused of deliberately holding a 42-year old woman against her will in a Wendy's restroom last month.
Franks' attorney told the judge he believes Franks is suffering from mental issues.
It's likely that Franks will be given a mental evaluation.
Franks faces up to 10 years in prison if he's convicted on the charge.
He will appear on a bond release when he makes his plea next week.
August 20th, 2013:George William Franks appeared in a Helena courtroom on Tuesday facing a charge of attempted kidnapping.
Franks, 60 years old, is accused of deliberately holding a 42-year old woman against her will in the women's restroom of Wendy's restaurant on Tuesday, August 13th, at around 8:30 pm.
The woman told police that she had gone to use the restroom and when she opened the door to leave, Franks was standing in the doorway and blocked her from leaving, and he tried to force the door shut with both of them inside.
The woman was able to force the door open and get out, and managed to kick Franks twice in the stomach.
She told police that that Franks was trying to trap her in the room, and she was afraid he may rape or assault her.
She closed the door and held it closed, and managed to yell for help from her daughter in the lobby and call 911.
When a police officer arrived with his Taser drawn, Franks was taken into custody.
Court documents state that Franks told officers he wanted to take the woman's clothes off so he could see her naked.
Franks is being held in jail on a $20,000 bond.
A court-appointed attorney asked for a mental evaluation and bond reduction for a later date.
