Bison can be transferred again after the Montana Supreme Court reverses a district court ruling that barred the state from moving quarantined bison.
That now old injunction was even though the animals were tested and found brucellosis free. The bison were to be transferred to two tribes in pastures on the Fort Peck and Fort Belknap Reservations.
After the injunction from the lower court prohibiting the transfer, the plaintiffs withdrew their request that the state FWP reclaim the 60 bison that already shipped to Fort Peck.
The plaintiffs said the injunction violated state law.
Montana's high court ruled the statute the lower court used did not apply to bison transferred to tribal lands, and they've sent it back to District Court.
