MISSOULA - Dilon Torey Franklin, the man who was shot while breaking into an armed 77-year-old man's home early Sunday morning is facing a felony burglary charge and three misdemeanors.
Franklin, 22 -ears-old, was arrested just before 2 a.m. on Sunday in the 500 block of North Pattee Street, where he told police he was high on heroin and meth.
Court documents say homeowner Robert Withrow Jones reported to 911 dispatchers that he had shot a man after allegedly warning him three times to stop.
Franklin had broken into Jones vehicle - leaving his iPhone behind - before throwing a porch chair through the victim's window to get inside.
Jones told detectives he woke up to the sound of breaking glass, became frightened for his life, and acted in self-defense.
Franklin was taken to St. Patrick Hospital with a single gunshot wound to the torso and is expected to live.
Police say that drugs found in Franklin's clothes have been sent to the State Crime Lab in Missoula for testing.
