A Montana judge has ordered the release of an edited version of the presentence investigation report relating to the 2009 boat crash involving state senator Greg Barkus.

Judge John McKeon also denied a motion by attorneys for Barkus to continue the case for another 30 days. The case involves an August 2009 boat crash on Flathead Lake.

Barkus and five other people including Congressman Denny Rehberg were injured in the crash.

A Washington D.C. congressional watchdog group Citizens for Responsibility and Ethics (CREW) filed to get the report released. The group says Rehberg may have lied in testimony after the crash.

The Rehberg campaign says it is a smear tactic, intentionally brought up just weeks before election time. Rehberg is in a hotly contested race for U.S. Senate with incumbant Jon Tester.

Judge McKeon says the CREW request appears to be politically motivated but the request is appropriate whether or not motivated by politics.
