MISSOULA - A Lolo man convicted and sentenced to 15 years in prison for killing a pedestrian while driving drunk is once again asking to delay his prison time.
In August of 2011, a Missoula jury convicted Brian Holm of deliberate homicide while under the influence for killing Brian Beaver as he walked on a sidewalk on Brooks Street.
But since that sentencing date, Holm has not served one day in prison.
His attorney filed a motion this week, asking for a 12 week delay while Holm completes his rehabilitation from heart surgery he underwent last month in Minnesota.
Over the course of two years, Holms has filed numerous appeals, which all have been denied.
