BOZEMAN - A new trial date is set for a former Gallatin County Sheriff's deputy to face a felony charge of mistreating a prisoner.
Thomas Madsen is accused of grabbing a teenage girl by the neck and pushing her against a wall while she was in custody in 2011.
He was originally charged with mistreatment of a prisoner, but Gallatin County district judge Holly Brown dismissed the felony charge, saying the girl wasn't technically a prisoner at the time.
However, last month the Supreme Court disagreed, saying the teen was indeed a prisoner because she was detained by law enforcement and overturned the dismissal.
On Wednesday, Judge Brown scheduled a five day trial for Madsen to face the felony charge beginning May 5th, 2014.
