On his last day in office, Governor Brian Schweitzer did not grant clemency to convicted murderer Ronald Allen Smith.
Smith is currently one of two men on death row in Montana and the only Canadian on death row in the United States.
Smith was convicted for the 1982 murders of Harvey Mad Man and Thomas Running Rabbit.
In 2012 Smith asked Schweitzer to reduce his sentence to life in prison without parole.
Schweitzer's policy advisor Eric Stern says after hearing the recommendation from the MT Board of Pardons & Parole, Schweitzer will not be acting on the case.
Stern says that Steve Bullock, who became Montana's governor on Monday, has the power to grant Smith clemency, but Schweitzer is choosing not to.
This is one of the last decisions Schweitzer made as Governor.
