BOZEMAN - A 77-year-old Three Forks man accused of sexually assaulting a developmentally disabled man at a downtown Three Forks park is being held on $50,000 bail.
Reynold E. Benusa appeared in Gallatin County Justice Court this morning via video from the Gallatin County Detention Center. He is charged with sexual intercourse without consent, a felony.
"There is a definite threat to the community," Judge Rick West said, noting that the alleged crime involved a developmentally disabled person and took place in a park where children were present.
According to court documents, the 38-year-old male victim said he was at the city park in Three Forks, taking pictures of the sunset, at around 7:30 p.m. Tuesday, June 11 when an elderly man drove up to him in a tan colored van and asked if he knew the Three Forks Café. The man then drove off, returned and parked next to the victim, got out of the van and began groping him, court documents state. The victim then said that the man pulled down his pants and began performing a sex act on him, but then suddenly stopped and said, "I'll see you tomorrow," before getting in the van and leaving, court papers state.
The victim told police he tried to tell the man to leave him alone but could not speak.
The victim reported the incident to police.
The next day, at around 6 p.m., the victim called police again to report that the same man had just solicited him for sex while he was walking down Main Street. He said the man pulled up beside him, rolled down his window and offered the victim $10 to go back to the park with him. The victim said he ran inside a bar and called for help.
Officers responded and found a man matching the suspect's description in a tan colored four-door van on Main Street.
Benusa was taken to the Three Forks Police Station where he reportedly admitted to police that on the night of June 11 he had a "sexual urge and acted upon it." Benusa reportedly admitted to performing the sex act on the victim.
Benusa was taken into custody and taken to the Gallatin County Detention Center.
Benusa, who is now retired, said in court that he operated pharmacies in Three Forks and Manhattan for 30 years.
